Armstrongs Stays Ahead, With Yet Another Successful Court of Appeal Judgement

Partner, Moemedi Tafa was successful in the Court of Appeal for our client Barclays Bank of Botswana. Barclays appealed against a High Court decision in which dismissed employees had been awarded three (3) years’ remuneration as damages. The Court of Appeal set aside the High Court decision and awarded the former employees the equivalent of two (2) weeks’ notice. The Court of Appeal confirmed, unequivocally, that damages for unlawful dismissals pursued in the High Court are limited to the notice period, where a contract provides for termination on notice.
