Judgement News- Another Successful Week In The High Court For Armstrongs
Armstrongs has successfully defended an action, the judgement in which resulted in the extension of the operation of the “once and for all rule”. His Lordship Justice Tafa found that the operation of the once and for all rule was not confined only to actions for damages. The judge found hat the Rule applies to all actions whether they be damages, services rendered or contractual and reiterated the rationale behind the Rule was to “guard against duplication of actions, possible conflicting decisions by different Courts on the same facts, and the expense of multiple proceedings. ” Armstrongs’ Litigation Partner John Carr- Hartley represented Minopex Botswana in the matter.
